TESTAMENTARY BEQUEST

Making a bequest to ARTandCHARITY O.D.V. means transforming your assets into a gesture of solidarity that lives on over time, supporting culture, art, and our social projects.

 

Ways to dispose of your assets

In your will, you can allocate your estate in two ways:

  • Heir appointment: a universal disposition, which concerns the entire estate or a portion of it. An ODV like ours can also be named as an heir. Upon the opening of the succession, the President or legal representative of the organization will evaluate the acceptance of the inheritance.
  • Legacy: a specific disposition, which allows you to leave specific assets or sums (for example, a sum of money, a property, or a work of art) to an organization or a person.

It is essential that the beneficiary organization is precisely identified in the will, indicating the name, registered office, and legal status, to avoid ambiguity. A generic indication (e.g. “to abandoned children”) would result in the assets being devolved to the testator’s municipality of residence.

 

Types of wills

Italian law provides for several methods:

  • Holographic will (art. 609 c.c.): written entirely by hand, dated, and signed by the testator. It is the simplest and most common form.
  • Public will (art. 603 c.c.): drawn up by a notary in the presence of two witnesses, ensuring maximum clarity and authenticity.
  • Secret will (art. 604 c.c.): delivered to the notary in a sealed envelope, which is kept sealed in the presence of two witnesses.

 

Subject of the bequest

The bequest can take different forms, depending on the wishes and possibilities of the testator:

  • the entire estate or a portion of it;
  • real estate (house, land, warehouse…);
  • sums of money, securities, shares, or investment funds;
  • movable assets such as jewelry, furniture, works of art;
  • life insurance policies;
  • severance pay (TFR).

 

Life insurance policies

A life insurance policy allows you to designate ARTandCHARITY O.D.V. directly as the beneficiary. In this case, a will is not necessary, because the insurance company pays the indicated sum following the insured event (death or disability).
The premiums paid are deductible in your tax return and the beneficiary can be changed at any time.

 

Tax benefits

Bequests in favor of a Voluntary Organization such as ARTandCHARITY O.D.V.:

  • are not subject to any inheritance or gift tax;
  • are received in full by the association, without tax deductions;
  • ensure that the testator’s charitable wishes are fully respected.

 

How to make a bequest to ARTandCHARITY O.D.V.

To include our association in your will, it is advisable to contact a trusted notary.
